By accessing or using the Fairway Fantasy website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes your acceptance of such changes.

2. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • • Provide accurate, current, and complete information during the registration process.
  • • Maintain and promptly update your account information to keep it accurate and complete.
  • • Maintain the security of your password and accept all responsibility for activities that occur under your account.
  • • Notify Fairway Fantasy immediately of any unauthorized use of your account or any other breach of security.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Fairway Fantasy and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fairway Fantasy. All statistics, scoring data, and player information are provided for entertainment purposes within the Service and may not be reproduced, distributed, or used commercially without express written permission.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. Refunds are issued at the sole discretion of Fairway Fantasy and are not guaranteed. We reserve the right to change subscription pricing with 30 days' advance notice.

6. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. FAIRWAY FANTASY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Fairway Fantasy is a fantasy sports platform for entertainment purposes only and does not constitute gambling.

7. Limitation of Liability

IN NO EVENT SHALL FAIRWAY FANTASY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
